1. Acceptance and Definitions
1.1 By accessing the hosting services offered by EvosHosting, the user agrees to comply with all the terms and conditions set forth in these Terms of Service. The user acknowledges having fully read and understood these terms and agrees to be bound by them.
1.2 Definitions:
- Client Area: The portal where clients can manage all services, accessible with their credentials at https://billing.evoshosting.com/.
- Credentials: The email and password used during registration to access the Client Area.
2. Terms of Use
2.1 Delivery
Our services have a maximum delivery time of 14 days. For dedicated servers, this time may extend up to 4 weeks due to additional configuration and setup requirements.
2.2 Machine Storage Content
EvosHosting is unable to access or read the contents of your disks. We are not responsible for any data loss caused by user actions or negligence. Users are advised to maintain their own backups.
2.3 IP Connectivity
Each VPS, VDS, and dedicated server is assigned a unique IPv4 address. This address must not be used for conducting DDoS attacks, BotNet operations, or any other illegal activities. Any illegal actions detected by the EvosHosting team will be prosecuted according to applicable laws.
2.4 CPU and Ram Usage
The use of CPU and RAM must be conducted appropriately and in accordance with Evos Hosting’s usage policies. Prolonged and constant usage of 90-100% of CPU or RAM may trigger a review of the VPS to check for any suspicious activities, such as cryptocurrency mining (e.g., Bitcoin) or any other illegal actions that violate Evos Hosting’s Terms of Service. In the event of a review, the inspection may be carried out in one of the following ways:
- Access via AnyDesk: The operator will perform the check through the remote support platform AnyDesk, with the customer’s consent and supervision.
- Access via customer-provided credentials: The customer will provide temporary access credentials, and the operator will carry out the monitored intervention, with the entire session being recorded to ensure transparency.
The customer will always be informed in advance before any intervention, and the review will be conducted with the utmost confidentiality and respect for privacy.
3. User Obligations
3.1 Information
Users must provide accurate and truthful information during account setup on billing.evoshosting.com. Accounts found with false information will be immediately terminated without refund.
3.2 Credential Security
Users are responsible for safeguarding their account credentials. EvosHosting provides features such as password reset to help maintain security.
3.3 Harmful Activities
Users must not use their accounts for any fraudulent or illegal activities. Any violations will result in immediate account suspension or termination.
4. Conditions of Use and Prohibited Actions
4.1 Resources
The provided machine resources can be used for any lawful purpose, except for the following prohibited activities:
- Cryptocurrency mining
- Engaging in illegal activities
- Actions intended to damage or interfere with the hardware or network of EvosHosting
- Remote DDos Protection
- VPN (Tunnel)
5. Duration of the Contract
5.1 Contract Duration
The contract duration is chosen by the user at the time of purchase and is specified in the service agreement.
5.2 Renewal
Services must be renewed prior to expiration to ensure continuous access. Failure to renew may result in service suspension.
6. Payments and Invoicing
6.1 Payment Methods
EvosHosting officially accepts payments via:
Payments are only valid if made through our official websites.
6.2 Data Access
Data related to machines/products is accessible only during the paid service period. If the service period expires or is revoked, data access will be terminated.
6.3 Automatic Renewals
Automatic renewals are conducted when possible, subject to user authorization, to prevent service interruptions. the debit is made up to 48 hours before the due date.
7. Responsibilities and Guarantees
7.1 Service Provision
EvosHosting provides services on an “as-is” basis. The only external program preloaded on the operating system (solely on VPS/VDS) is QEMU-Guest-User, necessary for remote machine control by the user and, if authorized, by the EvosHosting team.
7.2 Acceptance of Terms
Users accept these terms of service upon purchasing our services.
7.3 Service Damage
EvosHosting is not responsible for any actions that damage the purchased service. However, we reserve the right to intervene directly to mitigate such damage.
7.4 Data Responsibility
EvosHosting provides cloud backup solutions to ensure the security of client data. However, without the purchase of EvosHosting’s backup service, the company is not responsible for any data loss.
For clients who choose not to purchase a backup plan, it is strongly recommended to perform weekly backups to minimize the risk of losing important data.
8. Service Stability
8.1 Commitment
EvosHosting is committed to minimizing maintenance and downtime of its infrastructure to ensure high service availability.
8.2 Bandwidth Guarantee
EvosHosting guarantees a minimum inbound and outbound bandwidth of 500Mbit/s to ensure optimal performance.
8.3 VPS-VDS-GameServer Performance
In the event of slowdowns on VPS/VDS/GameServers, it is possible to request up to 1-10 additional days of service. Such requests will be evaluated by our staff according to the slowdowns experienced on the nodes or servers.
9. Service Suspension
9.1 Violations
EvosHosting reserves the right to suspend or terminate the service without notice if the user:
- Violates the Terms of Service
- Opens a dispute through the payment gateway
- Installs or uses malicious software such as viruses, trojans, botnets, spyware, etc.
- Abuses the service
- Provides false information (e.g., false address, name, and surname)
- Damages the EvosHosting infrastructure
10. Traffic Usage
10.1 Limits
Data transfer limits for our services are clearly specified on the product page and at the time of purchase. Exceeding these limits may result in suspension or restriction of the connection.
10.2 Unrestricted Data Transfer
All dedicated servers come with unrestricted data transfer to support extensive usage needs.
10.3 Fair Usage Policy
In cases of unfair usage, EvosHosting reserves the right to suspend or restrict traffic in scenarios of exceptionally high usage. This policy is intended to prevent network overload and deter attacks or excessive use of network resources. Users will receive an email notification at least 12 hours prior to any suspension.
11. Refund Policy
11.1 Service Issues
Refunds are only issued for verified server issues, which will be evaluated by our team.
11.2 Refund Period
Refund requests can be made within 7 days of purchase, subject to the following conditions:
11.2.1 First 24 Hours
Refunds requested within the first 24 hours will receive a full refund with valid proof.
11.2.2 First 3 Days
Refunds requested within the first 3 days require valid reasons and will be evaluated by our team.
11.2.3 First Week
Refunds requested within the first week require valid reasons and will be evaluated by our team. The refund amount will be 50% of the total service price.
11.2.4 After First Week
No refunds will be issued after the first week.
11.3 Refund Period Start
The refund period starts from the time of purchase, not from the time of machine delivery.
11.4 Maximum Refunds
A maximum of 2 refunds can be requested every 7 days.
11.5 Dedicate Refund
No refunds are issued on the dedicated for any reason
11.6 Refund Policy
Refunds can only be requested in the case of disruptions that result in a drop in performance of more than 30% compared to normal performance or in the case of problems with the anti-DDoS service. EvosHosting is committed to resolving such problems within 7 working days. However, if the problem is resolved within 24 hours, a refund will not be possible.
12. Contract Termination
12.1 Termination
EvosHosting reserves the right to terminate the contract at any time for valid reasons, without providing refunds.
13. Copyright
13.1 DMCA Protection
EvosHosting’s copyright is protected by DMCA. Unauthorized use of EvosHosting’s proprietary elements will result in legal action.
14. Licenses
14.1 License Usage
By accepting the contract, the customer certifies that all licenses provided by third parties are obtained from reliable sources and not from “nulled” licenses, illegal copies, or unauthorized sellers.
15. Abuse Requests
15.1 Reporting
Abuse requests must be sent to abuse@evoshosting.com.
15.2 Examination
Abuse requests will be examined within a maximum of 30 working days.
16. Changes to the Terms of Service
16.1 Modifications
EvosHosting reserves the right to alter or modify the Terms of Service at any time to add or remove clauses, sections, and more. Users will be notified of significant changes.
16.2 Data Deletion
In the event of service cancellation, users may request the deletion of their profile, which may take up to 90 days to complete.
